Acceptance

By using this site, you agree to these terms. If you do not agree, do not use the site. We may update these terms; the version live at this URL is the one that applies. Material changes will be reflected in the Last updated stamp above.

What this site is, and is not

This site is two things: a place to read essays, frameworks, and references published by The Crow's Signal, and a way to book a no-pitch consultation call.

This site is not:

a product purchase or subscription,
a self-service software application,
a substitute for professional advice (see the Disclaimer),
a contract for consulting services. Consulting engagements begin only with a separate, written agreement signed by both parties.

Operator

The Crow's Signal is a one-person consulting practice operated by Art Nikashin from Kazakhstan. References to "we," "us," and "our" in these terms refer to that practice.

Use of the site

You agree not to:

scrape the site at a rate or volume that interferes with normal operation,
attempt to bypass, disable, or compromise any security mechanism,
use the site to send unsolicited messages, malicious code, or automated abuse,
misrepresent your identity when booking a call or otherwise contacting us,
use the site to violate any law that applies to you.

Reasonable use for personal reading, sharing with attribution, and citing in your own work is welcome and does not require permission.

Intellectual property

The essays, frameworks, vocabulary, illustrations, code samples, and design system on this site are the work of The Crow's Signal unless otherwise marked. You may:

read and reference any of it,
quote short passages with attribution and a link back,
share links to pages on this site.

You may not, without prior written permission:

republish full essays or framework documents elsewhere,
use the brand name "The Crow's Signal" or the brand mark in a way that suggests endorsement,
train commercial models on bulk content from this site,
resell or repackage the content.

Booking a call

Booking a call through Calendly is not a commitment to a paid engagement, and it is not a contract. It is a 30-minute conversation. Either party may decline to proceed for any reason. Information you submit during booking is handled per the Privacy Policy.

Engagement terms published on this site

This site publishes the shape and the price of the work: a free fit call, bounded projects, and a monthly retainer. Those descriptions are summaries, written so you can decide whether to book before we ever speak. They are not an offer, and reading them does not start an engagement. Every paid engagement begins only with a separate written agreement signed by both parties, and that agreement governs the work. Where anything on this site conflicts with the signed agreement, the signed agreement controls.

Prices shown on this site are current as of the Last updated date above and may change for engagements that are not yet signed.

Fit call

The fit call is free and runs 30 minutes. Beforehand we review information that is already publicly visible about your organisation. That review needs no access to your systems and no time from your staff. It creates no obligation on either side, and either party may decline to go further for any reason.

Projects

A project is a bounded piece of work defined by a written acceptance specification, agreed and signed before work starts. That specification states what will be delivered and the conditions the deliverable must meet to be accepted. Work outside it is not part of the project.

Fees. Typically USD 2,500 to USD 7,500. Larger builds are scoped individually and priced in the engagement document.
Payment. Half the fee is payable to book the work. The balance is payable on acceptance. Invoice currency, payment method, and due dates are stated in the engagement document.
Acceptance. The deliverable is measured against the acceptance specification and nothing else. You review it within the period stated in the engagement document, then either accept it or identify in writing which items of the specification are not met.
If it does not meet the specification. We keep working at no additional charge until it does. If the deliverable still does not meet the specification at the end of the cure period stated in the engagement document, you may instead require a refund of the fees you have paid for that project.
Ownership. On final payment the deliverables and their documentation are yours. They are written to be operated without us.
Changes. Work that falls outside the acceptance specification is a change of scope. It is quoted and agreed in writing before it is started.

Retainer

The retainer is continuous ownership of the revenue systems layer, billed monthly, starting at USD 6,000 per month. The engagement document states the scope it covers, a named price for change orders outside that scope, the defined hours during which response times apply, a scheduled rate review, and the documentation and runbooks delivered as a standing part of the work. Either party may end the retainer on the notice stated in that document.

What a refund covers

The project refund described above is limited to the fees you have paid for that project. It is not compensation for time, opportunity, or any other loss. No refund is offered for the retainer, which is billed for a month of work already performed.

Third-party services

The Book a Call page embeds Calendly. When you interact with that widget, you also accept Calendly's terms and privacy policy. The Crow's Signal is not responsible for Calendly's service, uptime, or handling of your information beyond what is described in our own policies.

Disclaimers

The site, including its essays, frameworks, and case-study figures, is provided for general information only. It is not professional advice. Past results described on the site (revenue figures, lead volumes, ROI multiples) describe specific engagements in specific contexts. They are not predictions or guarantees of similar results in your situation. See the Disclaimer for the full statement.

The site is provided "as is" and "as available." We make no warranty of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement.

Limitation of liability

To the maximum extent permitted by law, The Crow's Signal will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of this site. Our total liability for any claim arising out of or related to your use of this site is limited to USD 100.

That limit applies to your use of this site. Fees payable and refundable under a signed engagement agreement are governed by that agreement, not by this cap.

Indemnification

You agree to indemnify and hold The Crow's Signal harmless from any claim or demand arising out of your misuse of the site or your violation of these terms. This indemnification is narrow and applies only to your conduct, not to the site's content.

Termination

We may suspend or end your access to the site at any time if you violate these terms or if continued access creates risk for the site or other visitors. We may also discontinue all or part of the site at any time without notice.

Governing law

These terms are governed by the law of the Republic of Kazakhstan, where the operator is based. Any dispute that cannot be resolved informally will be brought in the courts of Kazakhstan. Nothing in this section limits any rights you have under the mandatory consumer-protection law of your country of residence.

Severability

If any part of these terms is found unenforceable, that part will be limited or removed and the rest will remain in effect.

Changes

We may update these terms. When we do, we update the Last updated stamp above. Continued use of the site after a change means you accept the updated terms.
